COVID-19 impact – extension of applicability of certificate for lower or nil TDS and TCS

 

The COVID-19 pandemic has caused disruptions across the world, including India. HC upholds powers to conduct service tax audit even after introduction of GST

This Tax Alert summarizes a recent ruling of the Delhi High Court (HC)[1]. The issue under consideration was validity of Rule 5A of the Service Tax Rules, 1994, after introduction of the Goods and Services Tax (GST) law.

Rule 5A(1) empowered the officer authorized by the Commissioner to have access to any premises registered under service tax for carrying out scrutiny, verification and checks as may be necessary to safeguard the interest of Revenue.
